NYC Considers Auto-Enrolling Employees into BOE Retirement System

Legislation now before the New York State Assembly and Senate would allow automatic enrollment of eligible employees of the City of New York into the city Board of Education’s retirement system.

Under the bill, beginning July 1, 2023, any eligible new NYC employee eligible to join the New York City Board of Education retirement system who is not a member of the retirement system or any other run by the city or state would be automatically enrolled 91 days after his or her employment begins. 

Such new employees would be able to opt out, and the measure provides that the city and the applicable union would be required to provide written notice to the employee of that option three times at specified intervals. Employees who opt out would be able to apply to enroll in the future. 

Also, beginning July 1, 2023, current employees who are eligible and who are not members of the retirement system or any other run by the city or state would be automatically enrolled on Oct. 1, 2023 unless they opt out. 

The measure would apply to full-time and part-time employees, but not to provisional employees. 

The legislation, A09620, passed in the Assembly on June 2, 2022; the state Senate had passed S08644 on May 25 and is now considering the version the Assembly passed.
