Earnings Limitations Suspended in MN for Retired Teachers Who Return to Work

Minnesota Gov. Tim Walz (D) on May 22 signed into law a measure that enhances the earnings of retired teachers who return to work. The state House of Representatives passed the measure on May 9, and the Senate followed suit eight days later. 

The measure, SF 3540, includes a provision that suspends earnings limitations for retired teachers who resume teaching for a Minnesota public school or for the Perpich Center for Arts Education. It does not apply to those who resume teaching for a postsecondary institution, including a state college or university.

The measure says that no portion of a reemployed teacher’s annuity paid under Minnesota law shall be deferred, regardless of the amount of the salary earned from teaching service during the preceding fiscal year. In addition, no portion of a reemployed teacher's annuity paid under Minnesota law shall be deferred or forfeited regardless of the amount of the salary earned from the teaching service during the preceding calendar year. 

These provisions, however, have a limited shelf life—they apply only to salary earned during fiscal years 2022, 2023 and 2024 and to annuity payments made during calendar years 2023, 2024 and 2025.
