Q: I have been asked by a 501(c)(3) employer whether the summary plan description (SPD) must be filed with the Department of Labor (DOL). Must it?
A: Not any more (years ago, the SPD was required to be filed)! However, the SPD must be available for review by the DOL should they ask for it.
