Supreme Court to Review Consolidated Church Plan Cases

The U.S. Supreme Court will hear oral arguments on three church plan cases and review them as a consolidated case. The Court granted petitions for writs of certiorari on the cases on Dec. 2.

The cases are Dignity Health v. Rollins, Advocate Health Care Network v. Stapleton, and Saint Peter's Healthcare System v. Kaplan. At issue, says Scotusblog, is whether ERISA’s church-plan exemption applies as long as an otherwise-qualifying church-affiliated organization maintains a pension plan, or whether the exemption applies only if, in addition to an otherwise-qualifying church-affiliated organization maintaining the plan, a church initially established it.

Petitions for the writs of certiorari were made this summer: Advocate Health Care Network, July 15; Saint Peter's Healthcare System, July 18; and Dignity Health on Aug. 29.
