IRS Webinar on Minimum Present Value Requirements Coming

The IRS will be holding a webinar on minimum present value requirements for defined benefit plans in May.

The IRS on Sept. 8, 2016 issued TD 9783, which amends Internal Revenue Code Section 417(e) and Treas. Reg. §1.417(e)-1 and contains final regulations that modify minimum present value requirements for partial annuity distribution options under DB plans. The guidance in TD 9783 changes the regulations regarding the minimum present value requirements for DB plan distributions to permit plans to simplify the treatment of certain optional forms of benefit that are paid partly in the form of an annuity and partly in a single sum or other more accelerated form. The final rules were published in the Federal Register of Sept. 9, 2016.

The webinar will cover:

  • final regulations on partial annuity distributions under Section 417(e);

  • proposed regulations on other Section 417(e)(3) requirements;

  • types of benefit payments subject to MPV requirements;

  • application of mortality discounts; and

  • proposed clarification of existing Section 417(e)(3) rules.

The presentation will be posted on the IRS video portal in May 2017.
